Administrative Law Judge Says Washington State Perv Can Keep Ham License (Mar 10, 2010) -- In January 2007, the FCC issued an Order to Show Cause to David L. Titus, KB7ILD, of Seattle, Washington, to justify why his General class Amateur Radio license should not be revoked and initiated a hearing process to determine whether Titus “is qualified to remain a Commission licensee” in light of a 1993 felony conviction at the age of 18 for “communicating with a minor for immoral purposes.” According to the FCC order, Titus received a 25-month prison sentence for this act, and the Seattle Police Department has identified him as a registered sex offender. On March 9, Administrative Law Judge Richard L. Sippel issued his Initial Decision -- saying that Titus “has been a law-abiding member of his community for many years” and ordered that Titus’ license should not be revoked based on the evidence presented by the defendant and witnesses on his behalf, as well as the FCC’s Enforcement Bureau failure to meet the burden of proof necessary for revocation. The FCC has said that The Communications Act of 1934, as amended provides that the Commission may revoke any license if conditions come to its attention that would warrant a denial of the licensee’s original application. In the past, the Commission has said that felony convictions, “especially those involving sexual offenses involving children,” raise questions regarding a licensee’s character qualifications. Sippel’s Initial Decision shall become effective and this proceeding shall be terminated 50 days after its release if exceptions are not filed within 30 days thereafter, unless the Commission elects to review the case on its own motion.

If you’re reading this, you’re no doubt asking yourself, “Why did this have to happen?” The simple truth is that it is complicated and has been coming for a long time. The writing process, started many months ago, was intended to be therapy in the face of the looming realization that there isn’t enough therapy in the world that can fix what is really broken. Needless to say, this rant could fill volumes with example after example if I would let it. I find the process of writing it frustrating, tedious, and probably pointless… especially given my gross inability to gracefully articulate my thoughts in light of the storm raging in my head. Exactly what is therapeutic about that I’m not sure, but desperate times call for desperate measures.

We are all taught as children that without laws there would be no society, only anarchy. Sadly, starting at early ages we in this country have been brainwashed to believe that, in return for our dedication and service, our government stands for justice for all. We are further brainwashed to believe that there is freedom in this place, and that we should be ready to lay our lives down for the noble principals represented by its founding fathers. Remember? One of these was “no taxation without representation”. I have spent the total years of my adulthood unlearning that crap from only a few years of my childhood. These days anyone who really stands up for that principal is promptly labeled a “crackpot”, traitor and worse.

While very few working people would say they haven’t had their fair share of taxes (as can I), in my lifetime I can say with a great degree of certainty that there has never been a politician cast a vote on any matter with the likes of me or my interests in mind. Nor, for that matter, are they the least bit interested in me or anything I have to say.

Why is it that a handful of thugs and plunderers can commit unthinkable atrocities (and in the case of the GM executives, for scores of years) and when it’s time for their gravy train to crash under the weight of their gluttony and overwhelming stupidity, the force of the full federal government has no difficulty coming to their aid within days if not hours? Yet at the same time, the joke we call the American medical system, including the drug and insurance companies, are murdering tens of thousands of people a year and stealing from the corpses and victims they cripple, and this country’s leaders don’t see this as important as bailing out a few of their vile, rich cronies. Yet, the political “representatives” (thieves, liars, and self-serving scumbags is far more accurate) have endless time to sit around for year after year and debate the state of the “terrible health care problem”. It’s clear they see no crisis as long as the dead people don’t get in the way of their corporate profits rolling in.

And justice? You’ve got to be kidding!

How can any rational individual explain that white elephant conundrum in the middle of our tax system and, indeed, our entire legal system? Here we have a system that is, by far, too complicated for the brightest of the master scholars to understand. Yet, it mercilessly “holds accountable” its victims, claiming that they’re responsible for fully complying with laws not even the experts understand. The law “requires” a signature on the bottom of a tax filing; yet no one can say truthfully that they understand what they are signing; if that’s not “duress” than what is. If this is not the measure of a totalitarian regime, nothing is.

How did I get here?

My introduction to the real American nightmare starts back in the early ‘80s. Unfortunately after more than 16 years of school, somewhere along the line I picked up the absurd, pompous notion that I could read and understand plain English. Some friends introduced me to a group of people who were having ‘tax code’ readings and discussions. In particular, zeroed in on a section relating to the wonderful “exemptions” that make institutions like the vulgar, corrupt Catholic Church so incredibly wealthy. We carefully studied the law (with the help of some of the “best”, high-paid, experienced tax lawyers in the business), and then began to do exactly what the “big boys” were doing (except that we weren’t steeling from our congregation or lying to the government about our massive profits in the name of God). We took a great deal of care to make it all visible, following all of the rules, exactly the way the law said it was to be done.

The intent of this exercise and our efforts was to bring about a much-needed re-evaluation of the laws that allow the monsters of organized religion to make such a mockery of people who earn an honest living. However, this is where I learned that there are two “interpretations” for every law; one for the very rich, and one for the rest of us… Oh, and the monsters are the very ones making and enforcing the laws; the inquisition is still alive and well today in this country.

That little lesson in patriotism cost me $40,000+, 10 years of my life, and set my retirement plans back to 0. It made me realize for the first time that I live in a country with an ideology that is based on a total and complete lie. It also made me realize, not only how naive I had been, but also the incredible stupidity of the American public; that they buy, hook, line, and sinker, the crap about their “freedom”… and that they continue to do so with eyes closed in the face of overwhelming evidence and all that keeps happening in front of them.

Before even having to make a shaky recovery from the sting of the first lesson on what justice really means in this country (around 1984 after making my way through engineering school and still another five years of “paying my dues”), I felt I finally had to take a chance of launching my dream of becoming an independent engineer.

On the subjects of engineers and dreams of independence, I should digress somewhat to say that I’m sure that I inherited the fascination for creative problem solving from my father. I realized this at a very young age.

The significance of independence, however, came much later during my early years of college; at the age of 18 or 19 when I was living on my own as student in an apartment in Harrisburg, Pennsylvania. My neighbor was an elderly retired woman (80+ seemed ancient to me at that age) who was the widowed wife of a retired steel worker. Her husband had worked all his life in the steel mills of central Pennsylvania with promises from big business and the union that, for his 30 years of service, he would have a pension and medical care to look forward to in his retirement. Instead he was one of the thousands who got nothing because the incompetent mill management and corrupt union (not to mention the government) raided their pension funds and stole their retirement. All she had was social security to live on.

In retrospect, the situation was laughable because here I was living on peanut butter and bread (or Ritz crackers when I could afford to splurge) for months at a time. When I got to know this poor figure and heard her story I felt worse for her plight than for my own (I, after all, I thought I had everything to in front of me). I was genuinely appalled at one point, as we exchanged stories and commiserated with each other over our situations, when she in her grandmotherly fashion tried to convince me that I would be “healthier” eating cat food (like her) rather than trying to get all my substance from peanut butter and bread. I couldn’t quite go there, but the impression was made. I decided that I didn’t trust big business to take care of me, and that I would take responsibility for my own future and myself.

Return to the early ‘80s, and here I was off to a terrifying start as a ‘wet-behind-the-ears’ contract software engineer... and two years later, thanks to the fine backroom, midnight effort by the sleazy executives of Arthur Andersen (the very same folks who later brought us Enron and other such calamities) and an equally sleazy New York Senator (Patrick Moynihan), we saw the passage of 1986 tax reform act with its section 1706.

For you who are unfamiliar, here is the core text of the IRS Section 1706, defining the treatment of workers (such as contract engineers) for tax purposes. SEC. 1706. TREATMENT OF CERTAIN TECHNICAL PERSONNEL.

(a) IN GENERAL - Section 530 of the Revenue Act of 1978 is amended by adding at the end thereof the following new subsection:

(d) EXCEPTION. - This section shall not apply in the case of an individual who pursuant to an arrangement between the taxpayer and another person, provides services for such other person as an engineer, designer, drafter, computer programmer, systems analyst, or other similarly skilled worker engaged in a similar line of work.

(b) EFFECTIVE DATE. - The amendment made by this section shall apply to remuneration paid and services rendered after December 31, 1986.

Note:

· "another person" is the client in the traditional job-shop relationship.

· "taxpayer" is the recruiter, broker, agency, or job shop.

· "individual", "employee", or "worker" is you.

Admittedly, you need to read the treatment to understand what it is saying but it’s not very complicated. The bottom line is that they may as well have put my name right in the text of section (d). Moreover, they could only have been more blunt if they would have came out and directly declared me a criminal and non-citizen slave. Twenty years later, I still can’t believe my eyes.

During 1987, I spent close to $5000 of my ‘pocket change’, and at least 1000 hours of my time writing, printing, and mailing to any senator, congressman, governor, or slug that might listen; none did, and they universally treated me as if I was wasting their time. I spent countless hours on the L.A. freeways driving to meetings and any and all of the disorganized professional groups who were attempting to mount a campaign against this atrocity. This, only to discover that our efforts were being easily derailed by a few moles from the brokers who were just beginning to enjoy the windfall from the new declaration of their “freedom”. Oh, and don’t forget, for all of the time I was spending on this, I was loosing income that I couldn’t bill clients.

After months of struggling it had clearly gotten to be a futile exercise. The best we could get for all of our trouble is a pronouncement from an IRS mouthpiece that they weren’t going to enforce that provision (read harass engineers and scientists). This immediately proved to be a lie, and the mere existence of the regulation began to have its impact on my bottom line; this, of course, was the intended effect.

Again, rewind my retirement plans back to 0 and shift them into idle. If I had any sense, I clearly should have left abandoned engineering and never looked back.

Instead I got busy working 100-hour workweeks. Then came the L.A. depression of the early 1990s. Our leaders decided that they didn’t need the all of those extra Air Force bases they had in Southern California, so they were closed; just like that. The result was economic devastation in the region that rivaled the widely publicized Texas S&L fiasco. However, because the government caused it, no one gave a shit about all of the young families who lost their homes or street after street of boarded up houses abandoned to the wealthy loan companies who received government funds to “shore up” their windfall. Again, I lost my retirement.

Years later, after weathering a divorce and the constant struggle trying to build some momentum with my business, I find myself once again beginning to finally pick up some speed. Then came the .COM bust and the 911 nightmare. Our leaders decided that all aircraft were grounded for what seemed like an eternity; and long after that, ‘special’ facilities like San Francisco were on security alert for months. This made access to my customers prohibitively expensive. Ironically, after what they had done the Government came to the aid of the airlines with billions of our tax dollars … as usual they left me to rot and die while they bailed out their rich, incompetent cronies WITH MY MONEY! After these events, there went my business but not quite yet all of my retirement and savings.

By this time, I’m thinking that it might be good for a change. Bye to California, I’ll try Austin for a while. So I moved, only to find out that this is a place with a highly inflated sense of self-importance and where damn little real engineering work is done. I’ve never experienced such a hard time finding work. The rates are 1/3 of what I was earning before the crash, because pay rates here are fixed by the three or four large companies in the area who are in collusion to drive down prices and wages… and this happens because the justice department is all on the take and doesn’t give a fuck about serving anyone or anything but themselves and their rich buddies.

To survive, I was forced to cannibalize my savings and retirement, the last of which was a small IRA. This came in a year with mammoth expenses and not a single dollar of income. I filed no return that year thinking that because I didn’t have any income there was no need. The sleazy government decided that they disagreed. But they didn’t notify me in time for me to launch a legal objection so when I attempted to get a protest filed with the court I was told I was no longer entitled to due process because the time to file ran out. Bend over for another $10,000 helping of justice.

So now we come to the present. After my experience with the CPA world, following the business crash I swore that I’d never enter another accountant’s office again. But here I am with a new marriage and a boatload of undocumented income, not to mention an expensive new business asset, a piano, which I had no idea how to handle. After considerable thought I decided that it would be irresponsible NOT to get professional help; a very big mistake.

When we received the forms back I was very optimistic that they were in order. I had taken all of the years information to Bill Ross, and he came back with results very similar to what I was expecting. Except that he had neglected to include the contents of Sheryl’s unreported income; $12,700 worth of it. To make matters worse, Ross knew all along this was missing and I didn’t have a clue until he pointed it out in the middle of the audit. By that time it had become brutally evident that he was representing himself and not me.

This left me stuck in the middle of this disaster trying to defend transactions that have no relationship to anything tax-related (at least the tax-related transactions were poorly documented). Things I never knew anything about and things my wife had no clue would ever matter to anyone. The end result is… well, just look around.

I remember reading about the stock market crash before the “great” depression and how there were wealthy bankers and businessmen jumping out of windows when they realized they screwed up and lost everything. Isn’t it ironic how far we’ve come in 60 years in this country that they now know how to fix that little economic problem; they just steal from the middle class (who doesn’t have any say in it, elections are a joke) to cover their asses and it’s “business-as-usual”. Now when the wealthy fuck up, the poor get to die for the mistakes… isn’t that a clever, tidy solution.

As government agencies go, the FAA is often justifiably referred to as a tombstone agency, though they are hardly alone. The recent presidential puppet GW Bush and his cronies in their eight years certainly reinforced for all of us that this criticism rings equally true for all of the government. Nothing changes unless there is a body count (unless it is in the interest of the wealthy sows at the government trough). In a government full of hypocrites from top to bottom, life is as cheap as their lies and their self-serving laws.

I know I’m hardly the first one to decide I have had all I can stand. It has always been a myth that people have stopped dying for their freedom in this country, and it isn’t limited to the blacks, and poor immigrants. I know there have been countless before me and there are sure to be as many after. But I also know that by not adding my body to the count, I insure nothing will change. I choose to not keep looking over my shoulder at “big brother” while he strips my carcass, I choose not to ignore what is going on all around me, I choose not to pretend that business as usual won’t continue; I have just had enough.

I can only hope that the numbers quickly get too big to be white washed and ignored that the American zombies wake up and revolt; it will take nothing less. I would only hope that by striking a nerve that stimulates the inevitable double standard, knee-jerk government reaction that results in more stupid draconian restrictions people wake up and begin to see the pompous political thugs and their mindless minions for what they are. Sadly, though I spent my entire life trying to believe it wasn’t so, but violence not only is the answer, it is the only answer. The cruel joke is that the really big chunks of shit at the top have known this all along and have been laughing, at and using this awareness against, fools like me all along.

I saw it written once that the definition of insanity is repeating the same process over and over and expecting the outcome to suddenly be different. I am finally ready to stop this insanity. Well, Mr. Big Brother IRS man, let’s try something different; take my pound of flesh and sleep well.

Of all the years I have been a ham, I have only had a problem with one of the players in the 14.275 He just accused us of splattering. It wasn't worth the fight , so we QSY'd out of that area and I haven't had a problem since. saga. It was 'ol Mikey and I was in his .270-.280 window . What is it about that 10khz spectrum of 20 meters that draws the misfits to it? I hate the broadcasts of K1MAN but at least it has been quiet there. I haven't heard Karol, Mikey, Tom or any of the crew since K1MAN got back on and is being monitored heavily. I guess the misfits are scared that they will get caught in their antics. Laura may have contacted them and told them to cut it out. Lots of things could be speculated... There are plenty of frequencies/bands to use. Frankly, I like 17 meters and 6 meter SSB. I do chase some DX on 20 and even work some DX on 75/80 meters. Remember, Amateur Radio is a hobby. There will be disagreements and bullies in all aspects of your life. I learned something through trial and error a long time ago. Don't meet force with force. You can use someone else's force to work to your advantage if you'll just use your head. Given enough rope, they'll hang themselves. This is probably my last post to this board. After your anger or whatever you feel about this post wears off, take a look at yourselves and what has been going on. Is it really worth the effort?

Is it? consider this Stevie Dave dan whiny and other all spend a great
deal of time on the "issue" that I am bisexaul, something I try not to
bring up but frankly it isn't possible to not deal with around here.

It is said that roughly 10 percent of amercians are BLGT that is number
of more than 20 million people., and yet for if they are honest they
are suggejected to the relentless attacks of people like Stevie.
therefore a good case can be made that lying is a better idea than
hoesntly.

Indeed despite the fact I don't deny being bisexual Stevie says
everything I say is a lie or words to that effect. Stevie and MD went
looking for this years ago I gareed with them and said (and continue to
say it has nothing to do with ham radio) but 7 years later Stevie still
hammers at this issue BTW I have perhaps found an issue in Ham radio
where it has some bearing I don't see the gender of conectors in the
same way as the rest of you, not a major one but it came up this week,
thanks to someone signing their email "k4yz" sending email to many ham
in the area presumibly to inusre everyone knows this "vital fact" about
me, forunately for me who ever (and it may or may not be Stevie making
these mails which I have not seen with there header in place, Stevie
may be the victum of someone else here trying to provoke further
"entertainment" by signing stevie name) laced the mail without enough
over the top to be largely dismised

but back to the subject more than 50 percent of my children will bi or
gay according to studies. I know that fact. therefore for several
reason I will teach my children to lie.

there safety from Stevie or people likely whinny

taught that about everything they say to strangers online, about

try working for a world where being honest isn't flat out unsafe. Have

==>HAM RADIO SAVES THE DAY IN MISSISSIPPI; RITA RECOVERY CONTINUES IN TEXAS

Amateur Radio volunteers in Jasper County, Texas, continue to support
mass-feeding operations by The Salvation Army, which has been coordinating
with other relief groups to provide meals to Hurricane Rita-displaced
residents. Amateur volunteers plan to meet with Salvation Army personnel to
discuss the need for Amateur Radio support beyond this weekend. Meanwhile,
ARRL Alabama SM Greg Sarratt, W4OZK--who's been handling the intake of
American Red Cross volunteers in Montgomery, Alabama--has been visiting ARC
shelters along the Mississippi Gulf Coast. Shelters there are in the process
of closing down. In Gulfport, Amateur Radio volunteers continue to support
communication for the emergency operations center (EOC) in Harrison County,
where they've been a mainstay since Hurricane Katrina struck in late August.

"If it hadn't been for Amateur Radio operators, we would not have had
communications with other agencies," said Col Joe Spraggins of the Harrison
County Emergency Management Agency. "Even with the advancements in our radio
technology, ham radio saved the day! Thank you."

Christy Hardin, KB7BSA, a Southern Baptist Disaster Relief volunteer from
Alabama, and husband Rick, KB4BSA, have been in the Gulf Coast twice
following Hurricane Katrina. She had nothing but praise for those who have
been volunteering to maintain communication at the EOC 24/7 in some cases
despite having lost their own homes to the storm. "The four or five
operators who worked around the clock for nearly a month are the true
heroes," she said.

In particular, she cited ARES District Emergency Coordinator Tom Hammack,
W4WLF, Ray Taber, WX5AAA, Glover Hayden, W5BLV, and John Moore, W5EG, for
serving unselfishly on behalf of Mississippi Gulf Coast residents. Hammack
has been living in the EOC since the storm flooded and badly damaged his
house. An instructor for all three levels of the ARRL Amateur Radio
Emergency Communications course, Hardin says she was "thrilled to see it in
action" as the EOC volunteers performed as true professionals.

South Texas ARRL Section Manager Ray Taylor, N5NAV, this week estimated
upward of 60 Amateur Radio volunteers were on the ground in Texas, many
supporting shelters scattered throughout the area. North Texas SEC Bill
Swan, K5MWC, has been helping to recruit and schedule ARES members from his
section to assist in mass-care operations in Jasper County.

Taylor says radio amateurs in North Texas and Arkansas have been helping to
cover net control shifts and to serve as relay stations for the West Gulf
ARES Emergency Net on 7.285 MHz days/3.873 MHz evenings.

Scott Pederson, KI5DR, reports he just returned home from three days in
Jasper County, Texas, working with John Wagner, WA5VBP, Charles Fletcher,
N5BOY, and John Barber, N5JB. "Our job was to deliver hot meals to various
locations around a three-county area with five Salvation Army trucks and
also several Red Cross trucks working together," he said. Ham radio, he
explained, helped to coordinate the delivery routes by the various agencies
involved. While VHF FM simplex was okay for local work, the West Gulf ARES
Emergency Net on HF was very reliable.

"Even though regular phones are working most of the time, it's really the
hams that are the communicators of the group," he said. Pederson also lauded
the efforts of The Salvation Army, American Red Cross and Arkansas Methodist
Men's volunteers. "Everyone is focused and cares deeply about their tasks,"
he said, "and things are happening at lightning speed throughout the day."

In Louisiana, SEC Gary Stratton, K5GLS, said earlier this week that some 45
Amateur Radio volunteers remained on hurricane recovery duty there. "Things
are settling down," Stratton told ARRL.--Christy Hardin, KB7BSA, supplied
information for this article.

Hundreds of Amateur Radio operators from the Gulf Coast and elsewhere in the
US continue to volunteer their skills and expertise as the Hurricane Katrina
relief effort heads into its third week. ARRL Section Managers (SMs) and
Section Emergency Coordinators (SECs) across and around the affected region
have been teleconferencing daily to keep their efforts on the same page. In
the field, Amateur Radio Emergency Service (ARES) and other volunteers are
assisting as needed to support communication for relief agencies as well as
for state and local government and even the Federal Emergency Management
Agency (FEMA). Louisiana SEC Gary Stratton, K5GLS, says Amateur Radio was
the only means for state officials at the state emergency operations center
(EOC) in Baton Rouge to communicate earlier this week with the so-called
"Florida parishes" above Lake Pontchartrain.

"We have had praise from one end of Louisiana to the other about Amateur
Radio operators," Stratton said. "There was a communication to the EOC in
Baton Rouge from FEMA that said, 'Ham radio is our prime communications with
you, and they should get anything they need,' so FEMA recognizes the
importance of ham radio." He also recounted how state officials arriving at
the EOC were using ham radio to get through to their hard-hit parishes.

A marshaling center has been established in Covington, Louisiana. ARES has
been continuing to support Red Cross shelter and Southern Baptist Convention
debris-clearing in St Tammany parish, as well as Baptist Men's Kitchen
canteen operations. In Washington Parish, ARES volunteers--including more
than a dozen from South Texas--have been providing critical communication
among hospitals and the parish EOC, among other functions. Field teams were
continuing to use HF to maintain communication with the EOC in Baton

Mark Morgan, KB9RQZ, is in the news again. Michigan law enforcement records indicate a large number of new complaints have been made regarding Morgan. Complaints include false SOS calls, criminal libel, false swearing, false statements to federal officials, false statements to state officials, false claims of shooting at a minor and wounding him, leaving a blood trail, and a host of other complaints.

You may recall that Morgan refers to himself as Karol Madera's "ally." Morgan, who resides at 17366 River Road, Chassell, MI, also describes himself as a kinky, bi-sexual, into (BDSM) bondage, domination, and sado-masochism.

Morgan has made reports about at least six different men to child protection services in at least 6 different states -- at the urging, and under the guidance of Karol Madera, who also provides content for at least 3 defamatory blogs under the control of Mark Morgan. All of Morgan's reports have been unfounded, his criminal libel reported, and the FBI provided with a record of complaints about Morgan, whose blogs have no basis in truth, or reality.

In fact, Morgan was cautioned by the FCC that he should refrain from libeling others, yet Morgan has continuously libeled others, and this has apparently been happening for years. Morgan was voted out of the CCRAA amateur radio club, and he left office early, in disgrace, at least partly as a result of Morgan's reputation as a liar who has made false reports about others.

If this pattern of behavior continues, Morgan may be ordered by the court to undergo a mandatory psychiatric evaluation, in addition to possibly being criminally and civilly liable for false swearing and other malfeasance.

According to law enforcement authorities in Michigan, and at least 3 different websites, Morgan is no stranger to the courts, and there may, in point of fact, be madness behind Morgan's methods. Morgan has previously admitted he was transported to a hospital in Marquette in 2004, under Michigan's Act 48 statute, which states, in part:

MICHIGAN MENTAL HEALTH CODE (EXCERPT)

Act 258 of 1974

330.1401 “Person requiring treatment” defined

(1) As used in this chapter, "person requiring treatment" means (a), (b), (c), or (d):

(a) An individual who has mental illness, and who as a result of that mental illness can reasonably be expected within the near future to intentionally or unintentionally seriously physically injure himself, herself, or another individual, and who has engaged in an act or acts or made significant threats that are substantially supportive of the expectation.

(b) An individual who has mental illness, and who as a result of that mental illness is unable to attend to those of his or her basic physical needs such as food, clothing, or shelter that must be attended to in order for the individual to avoid serious harm in the near future, and who has demonstrated that inability by failing to attend to those basic physical needs.

(c) An individual who has mental illness, whose judgment is so impaired that he or she is unable to understand his or her need for treatment and whose continued behavior as the result of this mental illness can reasonably be expected, on the basis of competent clinical opinion, to result in significant physical harm to himself, herself, or others. This individual shall receive involuntary mental health treatment initially only under the provisions of sections 434 through 438.

(d) An individual who has mental illness, whose understanding of the need for treatment is impaired to the point that he or she is unlikely to participate in treatment voluntarily, who is currently noncompliant with treatment that has been recommended by a mental health, professional and that has been determined to be necessary to prevent a relapse or harmful deterioration of his or her condition and whose noncompliance with treatment has been a factor in the individual's placement in a psychiatric hospital, prison, or jail at least 2 times within the last 48 months or whose noncompliance with treatment has been a factor in the individual's committing 1 or more acts, attempts, or threats of serious violent behavior within the last 48 months. An individual under this subdivision is only eligible to receive assisted outpatient treatment under section 433 or 469a.

(2) An individual whose mental processes have been weakened or impaired by a dementia, an individual with a primary diagnosis of epilepsy, or an individual with alcoholism or other drug dependence is not a person requiring treatment under this chapter unless the individual also meets the criteria specified in subsection (1). An individual described in this subsection may be hospitalized under the informal or formal voluntary hospitalization provisions of this chapter if he or she is considered clinically suitable for hospitalization by the hospital director.

Mark keeps implying that I am the one who forces him to flood. So I thought what the hey, I will not post on RRAP or NIM, I would lock down this blog, and would see what would happen. I was hoping that Mark would calm down and stop spazing out about "dloyd", RRAP would get back to normal, and I could quietly delete this blog, but what I thought would happen did happen. Mark slowed down for a few days...but then those voices in his head could not be contained. He is off to flooding again and raving about "dloyd." What am I supposed to do, give up my right to exist on the net because Mark can't control himself evertime he sees me post or thinks I have posted? You just can't reason with a kook.

I see that "D' and company are making headway on the ISP front. Apparently, Terra has rightly given Mark a boot in the ass, and for the time being he is having trouble flooding through Terranews. I'll try to keep people up to date about the status of the complaints in this entry. What we are trying to do is to submit so many complaints to Hughes that they'll finally take action. Your complaint could be the one which makes a difference.

It is possible that Hughes has blocked free email accounts like Yahoo, Gmail, and Hotmail. People have reported receiving no response from Hughes when sending email from such accounts (see the first comment for a typical response). If you don't get a canned response, retry your complaint from one of your own mailboxes at your own ISP, and be sure to address your email to both abuse@hughes.net and abuse@hughes.com.

As of this writing, I am aware of nine people, including myself, who have emailed thirteen abuse complaints to Hughes Network Systems (see the comments).

Totals: Thirteen emails of complaint confirmed. Three telephone calls; one surface mail sent on Jan 7, 2008 (returned - see below); two surface mails sent on Jan 10, 2008. Two surface mails sent on Jan 14, 2008.

The lack of response from the abuse accounts has caused us to shift to a letter writing campaign. The total number of letters sent is known to be at least four, and may be as high as eight (It is difficult to get confirmation from some people that they have actually put letters in the mail).

The surface mail sent on Jan 7, 2008 and addressed to Robert C. Lewis was returned completely unopened ("Not here" written on front of envelope). Mr. Lewis has apparently left the company or retired.

Since Mark has a copy cat blog of this one, I figured I would check it out. Well, its the same old drool that is consistent with all of Mark's blogs. Except for the editing by Mark and using Mark's twisted rationale, he pretty much is a "theif" and stole my posts word for word from my blog. I've been directly responding to Mark way to much on RRAP these days, but it really is at a stalemate. He won't take responsibility for anything and his rant is getting to be so redundant, its like riding on the same roller coaster over and over again. He is even starting to lie about how he lost his former blog, now stating that he accidently deleted it, and when he recreated the blog, he made a typo in the name. But IMO this is false, because his former blog was down for at least three days, and then he hastely created the new blog with another person's call similar to his, but he only did this after I had already obtained this domain, and pointed out that his blog was gone (shame on you Mark for trying to pull the wool over our eyes) but that didn't last very long, because when he was called on the carpet by another poster on RRAP for using the other persons call, he freaked and created his current blog. Nevertheless, at this time I will no longer be grantng his desperate plea for attention, I may again try to engage in dialoge with him in the future, but the future does not seem to be promising unless I see a change in Mark's posting behavior and attitude.

I see that Morkie has continued his spam attack on RRAP. As far as traditions go, taking and passing a code test was more of a tradition than anything kooky Mark could ever dream up. It was a rite of passage into Amateur Radio, it really showed a level of individual commitment for someone to go and earn a license beyond novice, but of course Mark could never understand that or pass a real ham test until it was dumbed down. This one really made me laugh "Dloyd claims ham are supposed to be rotten to newer hams" I never use the term rotten, unless of course, I am talking about Markie's brain. But Mark has been a ham for at least a few years, so how can he be a newer ham? Nevertheless, I welcome any new ham into the service, because they have no control over the current licensing procedures, why penalize someone for procedures that are out of their control. However, Mark has been licensed long enough to have passed at least the 5 WPM exam, but he didn't think enough of the ARS, or to take enough pride in himself to work to meet the qualifications for a higher license. Just like most slackers, he sat around on his butt, and waited for someone to give him something. Mark is such an idiot he still thinks no one likes him because of his sexuality or because he is a no coder. He still can't conceptualize the reasons he is so disliked even though he has been told several times. This one is funny "Dloyd his life is reduced to stealing bits of other people lives" I have never stolen anything, Mark manages to lose things, such as his blog, either by his own blunders or by being TOS'ed, and he and his wife also put a lot of their personal business out in the public domain. Mark then whines when I or others assume control of such, or use such information to refute Mark's lies, or his outlandish slanderous claims against ourselves or other individuals. You know, that's the problem with people like Mark, he doesn't realize that he is abnormal, he thinks everyone is just like him, his perception couldn't be any farther from the truth. He wants to engage users of RRAP and RRAM in his "games", and then when he starts to lose or look bad, he cries foul and claims harassment and stalking. He also likes to whine about all of these charges of alleged broken laws in which he is a victim, yet he has no proof, and there is no evidence that anyone has ever been charged with anything based upon his perpetual lying. IMO, no one every will, it is obvious to me that Mark has serious credibility issues and any Law Enforcement official can easily see right though his incredible tall tales of being a "victum." IMO, the truth is the real stalker and harasser of the NG's is none other than Mark Morgan himself. He has been harassing the users or RRAP and RRAM with his bombardment of spam for many years, so much to the extent, that even a moderated group had to be created so the users of RRAP and RRAM would have a place to post in peace. Of course Mark is allowed to post there, moderated, because if he was barred all together, Mark would no doubt make a bunch of accusation that he was barred because, a. He is Jewish, b. He is bi-sexual, or c. He is a no-coder, you can pick whichever excuse you want, but I can guarantee that if Mark was barred from posting on the moderated group, he would pick all three, after all he is the eternal "victum"

Checked out RRAP this morning. It appears that Morkie has gone on a Steve Spamathon Tirade. He is so desperate, Mark has even gone into the archives and dredged up old threads so he can have something to post...LOL I love Dee's past remark to Mark, it is so right on target. "It must truly be hell to be at the mercy of everyone in the world." Mark seems to be such a tormented soul without any tormentors. With all of the things he alleges has happened to him during his interaction with Usenet, you think he would at least attempt to resolve his differences with the group, but of course it is impossible to have dialogue with the unreasonable, and someone who's thought process appears to be so twisted that his rationale shows no evidence of common sense. Of course Markie is the one who is correct and it is everybody else who is wrong....what were we thinking...LOLJust another page in the book of Markie the Spammer and Usenet Destroyer.

Mark posted a "reasponse" on his blog in response to my post here concerning the crimes that he alleges I committed, but as I said, I was only going to respond to him once. Once again his writing looks like a six year old ate a huge serving of alphabet soup and then vomited on the screen, a jumble of mis-spellings, butchered grammar, twisted rationals, and misconstrued interpretations of the law. I can only say that I have never received any complaints concerning my grammar skills or spelling, or about my presence on RRAM or RRAP, something that he can never honestly say. Well, I guess that he will continue to whine and play the victim because he is unable even conceptualize that his behavior on the Usenet groups is totally inappropriate, and in response, I suppose that others will continue theirs.
